Can a parent refuse their handicap child from attending school?

I know someone with a child with Down Syndrome and the child is now 5 yrs. old. The child was in a community program to get the child ready for school, and as soon the child turns 3 the child goes to public school for continuing education and speech therapy services. I know having a child with a disability will have emotional conserns because I also have 2 children who are autistic and the best thing for them was to give them education and independence. I know it’s hard to let her child go, but there are many parents who have to do what is best for their child to get the best possible education. The other thing is the child has to go in a school bus with obviosly with trained aids in the bus and she doesn’t want her to go, actually she wants to go to school with her everyday, but the parent does not know how to drive. What are the consenquences for not enrolling your child in school. The parent does not have even the education to have her home schooled nor to transport her to school.
First the child is my niece and I work at the school where is supposed to be at.
I know the teachers very well who are highly trained, and her other children wen to school their too. She know the school very well.The parent is an illegal alien and does not have the education to teach her child. She did state that they have called it to her attention about her child not being in school. I know the child will be fine because I will be there to check up on her and plus she is my niece who love to death. I just think she needs more interaction with children, which she does not now. The mom keeps her inside the house for weeks,she doesn’t even take her outside or to the park or even make play dates so her daughter could soilcialize. I’m just suggesting that going to school will be the best for her than being stuck inside her home. Which is not healthy.
